Petitions Filed Seeking to Rescind SL Order Limiting President’s Judicial Nominations

Two intervenient petitions have been filed in the Supreme Court (SC) seeking to rescind the interim order that prevents the President from submitting nominations for Supreme Court vacancies other than the position of Chief Justice, the Daily Mirror reported.

Dr. Mahim Mendis and Ven. Dambara Amila Thero filed these petitions to amend the interim order while ensuring the appointment of Justice Nissanka Bandula Karunaratne, President of the Court of Appeal, to the Supreme Court with due seniority.

On April 30, 2024, the SC issued an interim order restricting the President from submitting any nominations for SC vacancies other than for the Chief Justice position.

This order followed a Fundamental Rights petition by Attorney Sarith Maheeputhra Pathirathne, seeking an order for the Constitutional Council to approve the President’s recommendation to appoint Nissanka Bandula Karunaratne as a Supreme Court judge.
